6. Online Bookings


Except as set out below, there are no rights of refund or exchange, and you acknowledge that the cancellation rights contained in the Consumer Protection (Contracts Regulations 2015 and Consumer Contract Regulations 2013) do not apply to the services we offer.
When you make a booking by way of the ordering process set out on this website and by these Terms, the identity of the company with which you are agreeing is Statfold Narrow Gauge Trust (Incorporation number: 10919496 registered office: Statfold Barn Farm, Ashby Road, Tamworth, Staffs B79 0BU)


All prices and fees are in pounds sterling and include any applicable Value Added Tax.


Payment will be charged to your card at the time of processing your credit/debit card transaction. You cannot use any promotional vouchers or discount cards in conjunction with a booking via this website except where specifically stated.


If Statfold Narrow Gauge Museum Trust accepts your booking, we will display a confirmation page on your screen at the end of the ordering process, and at this point, there will be a contract between you and the company. Such a contract will be governed by English law and will be subject to the non-exclusive jurisdiction of the English courts. We will also send you a secondary e-mail confirmation of your completed order, for your information. We do not file details of your order for you to access on this website, so we recommend that you print out a copy of the confirmation page and/or confirmation e-mail for your records.


When you make a booking via this website, all transaction details that you provide to Statfold Narrow Gauge Museum Trust (including your name and credit card details) will be held and used by our Privacy Policy and will be encrypted using SSL (secure sockets layer) technology. It is your responsibility to check your booking details as we are under no obligation to rectify mistakes after a contract has been formed.

 

Please also note that we are not under an obligation to provide the services(s) to you at the incorrect (lower) price, even after the confirmation page has been displayed and the confirmation email has been sent to you, if such a pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing.


Unless otherwise expressly stated on this Web Site, bookings cannot be amended or refunded.


Please only buy tickets via our official ticket site (https://statfoldbarnrailway.digitickets.co.uk/tickets).


We will not be obliged to honour any tickets resold and they may be voided.

If we believe that a violation of these Terms (or any of the rights identified in these Terms) has occurred, we may suspend or bar your access to this website or take such other corrective action as we deem appropriate.

We accept no responsibility for any personal property that is brought to Statfold Narrow Gauge Museum Trust.

We reserve the right to refuse admission to The Big Statfold Weekender should you breach any of Statfold Narrow Gauge Museum Trust terms and we may on occasion have to conduct security searches to ensure your safety.


Statfold Narrow Gauge Museum Trust's failure to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right.


Statfold Narrow Gauge Museum Trust may assign, transfer or declare a trust over the benefit of its rights and obligations under these Terms to any party at any time without notice to you. You may not assign, transfer or declare a trust over your rights or obligations under these Terms without Statfold Narrow Gauge Museum Trust’s prior written consent, which may be withheld in its absolute discretion.
Statfold Narrow Gauge Museum Trust will not be in breach of these Terms or otherwise liable for any delay in performance of them to the extent that such breach or delay is due to circumstances beyond its reasonable control.


If any part of these Terms is unenforceable, invalid or illegal (including any provision in which Statfold Narrow Gauge Museum Trust excludes its liability to you), the enforceability, validity or legality of any other part of these Terms will not be affected or impaired in any way.


These Terms embody and set forth the entire agreement and understanding between us and supersede all prior oral representations (including negligent representations) or written agreements, understandings or arrangements concerning the subject matter hereof. Neither of us shall be entitled to rely on any agreement, understanding or arrangement which is not expressly outlined in these Terms. The provisions of this clause shall not exclude any liability or any right which either of us may have in respect of any statements made fraudulently before you accepted these Terms or any fraudulent concealment by the other.


Any notice to be given by either of us to the other may be sent by email, fax or recorded delivery to the address of the other. In the case of Statfold Narrow Gauge Trust (Incorporation number: 10919496 registered office: Statfold Barn Farm, Ashby Road, Tamworth, Staffs B79 0BU), as amended herein from time to time. In your case, such an address shall be that provided at the time of registration or such other address as you may from time to time have communicated to Statfold Narrow Gauge Trust in writing or by email to info@statfold.com. If sent by email, a notice shall be deemed to be received on the day it was sent or, if sent by fax, shall be deemed to be served on receipt of an error-free transmission report or, if sent by recorded delivery, shall be deemed to be served two days following the date of posting.


Save as expressly provided in the first paragraph of these Terms, no provision of any of these Terms may be amended, varied or waived by Statfold Narrow Gauge Trust except in writing signed by an authorised representative of Statfold Narrow Gauge Trust.


Some of the provisions of these Terms are for the benefit of Statfold Narrow Gauge Trust and its officers, directors, employees, agents, subsidiaries, affiliates, suppliers and third-party information providers. Each of these persons or entities shall have the right to assert and enforce those provisions directly against you on its behalf if you violate any of these Terms. Save for the foregoing, the Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms and no rights or benefits expressly or impliedly conferred by them shall be enforceable under that Act against the parties by any other person.


When making a booking you are reserving an event for the start time as indicated on your booking confirmation. If you are unable to attend or arrive late, Statfold Narrow Gauge Museum Trust is under no obligation to either hold the event or offer an alternative time slot and operates a strict no-refund policy.


10. General Bookings


If you wish to book an event we will need to know your name, e-mail address and credit card details. We gather this information to allow us, our agents, and sub-contractors to process your booking and to send you an e-mail confirmation of each booking. Packages and offers are subject to availability.


11. Social Media Competitions

Competitions are open to residents of the United Kingdom aged 18 years or over except employees of Statfold Narrow Gauge Museum Trust, close relatives and anyone otherwise connected with the organisation or judging of the competition.


There is no entry fee and no purchase necessary to enter our social media competitions. By entering a competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.


Only one entry will be accepted per person. Multiple entries from the same person will be disqualified.


No responsibility can be accepted for entries not received for whatever reason.


The rules of the competition and how to enter are as follows:
The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.


The promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
There is no cash alternative for prizes and prizes are not transferable. Prizes are subject to availability, and we reserve the right to substitute any prize with another of equivalent value without giving notice.


Winners will be chosen at random by software, from all entries received and verified by promoter and or its agents.


The winner will be notified by email and/or DM on Twitter/Facebook and/or letter within 7 days of the closing date. If the winner cannot be contacted or does not claim the prize within 7 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.


The promoter will notify the winner to arrange for the prize to be delivered.


The promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.


The competition and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.


The winner agrees to the use of his/her name and image in any publicity material, as well as their entry. Any personal data relating to the winner, or any other entrants will be used solely by current UK data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.


Entry into a social media competition will be deemed as acceptance of these terms and conditions.


12. Stay safe for your visit


Here at The Big Statfold Weekender, Statfold Narrow Gauge Museum Trust want you to have as much fun as possible, but your safety is always extremely important to us too. 
•    Please ensure that all young children are always supervised and that they do not run around the event grounds and railways as this could cause injury.
•    Keep a safe distance from railway tracks and moving engines.
•    Do take instructions from Statfold Narrow Gauge Museum Trust staff.
•    Make sure you arrive in time for your allocated booking.
•    Come prepared with outdoor clothing and shoes.
If you are unsure of anything then please ask a member of staff.
13. Complaints
If you have any issues during your visit please bring them to the attention of the Statfold Narrow Gauge Museum Trust staff so that there is an opportunity to rectify the situation.
You can raise a complaint with us by writing or emailing us through the contact details on the contact page of the website.
Your complaint will be acknowledged within 14 days and you will receive a reply no later than 4 weeks after this acknowledgement.
